1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you and Geto Plus Ltd ("Geto Plus", "we", "our", or "us") governing your access to and use of the Geto Plus mobile application, website, and all related services (collectively the "Service").
By creating an account, making a booking, listing a property, or otherwise accessing the Service, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.
2. Eligibility
To use the Geto Plus Service, you must:
- Be at least 18 years of age.
- Have the legal capacity to enter into a binding agreement.
- Not be prohibited from using the Service under applicable law.
- Provide accurate, complete, and current registration information.
By using the Service, you represent and warrant that you meet all eligibility requirements.
3. User Accounts
3.1 Account Registration
You must create an account to access most features of the Service. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.
3.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at support@geto.plus if you suspect any unauthorised use of your account. Geto Plus is not liable for any loss resulting from unauthorised access to your account.
3.3 One Account Per User
Each user may maintain only one personal account. Property owners may create a business profile linked to their personal account. Creating multiple accounts to circumvent restrictions or policies is prohibited.
4. Guest and Tenant Terms
4.1 Booking Process
When you make a booking on Geto Plus, you are entering into a direct agreement with the property owner or hotel. Geto Plus acts as a marketplace platform and is not a party to the accommodation contract between you and the host.
4.2 Guest Responsibilities
- Provide accurate information when making a booking, including the number of guests and intended purpose of stay.
- Treat the property and its contents with respect and care.
- Comply with the host's house rules, check-in/check-out times, and any applicable local laws.
- Not engage in any illegal activities on the property.
- Report any damage or maintenance issues promptly to the host.
- Pay any outstanding charges, damage fees, or penalties as agreed.
4.3 Accuracy of Information
While we strive to ensure listings are accurate, Geto Plus does not guarantee the accuracy of descriptions, photos, or amenities listed by property owners. We encourage guests to communicate directly with hosts before booking.
5. Property Owner and Hotel Terms
5.1 Listing Requirements
To list a property on Geto Plus, you must:
- Be the legal owner or authorised representative of the property.
- Provide accurate, truthful, and up-to-date listing information.
- Comply with all applicable local laws, including zoning, licensing, and tax regulations.
- Maintain appropriate insurance for your property.
- Complete Geto Plus's identity and property verification process.
5.2 Listing Content
Property owners are responsible for all content in their listings, including photos, descriptions, pricing, and availability. You warrant that your listing content does not infringe any third-party rights and is not misleading, false, or deceptive.
5.3 Host Responsibilities
- Respond to booking requests and guest enquiries within 24 hours.
- Honour all confirmed bookings unless cancelled within the permitted window.
- Ensure the property is clean, safe, and as described in the listing.
- Provide accurate check-in instructions and be reachable during the guest's stay.
- Comply with all tax reporting requirements for income received through the platform.
6. Payments and Fees
6.1 Payment Processing
Geto Plus facilitates payments between guests and property owners through licensed payment partners including M-Pesa, Airtel Money, and card payment processors. All transactions are processed in Tanzanian Shillings (TZS) unless otherwise specified.
6.2 Service Fees
Geto Plus charges a platform service fee on each completed booking. The applicable fee structure is displayed at the time of booking or listing and may be updated with prior notice. Current fees:
- Guest service fee: Displayed at checkout before payment confirmation.
- Host service fee: A percentage of each booking value, deducted before payout.
- Fees are non-refundable except where a booking is cancelled by the host.
6.3 Payouts to Hosts
Hosts receive payouts to their registered mobile money or bank account, typically within 1–3 business days after guest check-in, minus applicable platform fees. Geto Plus reserves the right to hold payouts in cases of disputes, fraud investigations, or policy violations.
7. Cancellations and Refunds
7.1 Guest Cancellations
Refund eligibility depends on the cancellation policy selected by the property owner (Flexible, Moderate, or Strict). The applicable policy is clearly displayed on each listing before booking.
- Flexible: Full refund if cancelled 24+ hours before check-in.
- Moderate: Full refund if cancelled 5+ days before check-in; 50% refund thereafter.
- Strict: 50% refund if cancelled 7+ days before check-in; no refund within 7 days.
7.2 Host Cancellations
If a host cancels a confirmed booking, the guest receives a full refund including service fees. Repeated host cancellations may result in penalties, reduced search visibility, or account suspension.
7.3 Extenuating Circumstances
In cases of natural disasters, government-declared emergencies, or other extraordinary events beyond a party's control, Geto Plus may apply an Extenuating Circumstances Policy that overrides standard cancellation policies.
8. Prohibited Conduct
You agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms.
- Post false, misleading, or fraudulent listings or reviews.
- Circumvent the platform by conducting transactions off-platform to avoid service fees.
- Harass, threaten, or discriminate against other users.
- Use the Service to facilitate human trafficking, exploitation, or any criminal activity.
- Attempt to access other users' accounts or the platform's backend systems without authorisation.
- Scrape, copy, or redistribute platform content without permission.
- Upload viruses, malware, or any harmful code.
- Manipulate ratings, reviews, or search rankings.
9. User Content
By submitting content (photos, descriptions, reviews, messages) to Geto Plus, you grant us a non-exclusive, royalty-free, worldwide licence to use, display, and distribute that content in connection with the Service. You retain ownership of your content and remain responsible for it.
We reserve the right to remove any content that violates these Terms, is offensive, or is otherwise inappropriate, at our sole discretion and without prior notice.
10. Intellectual Property
The Geto Plus name, logo, app design, software, and all related content are the exclusive intellectual property of Geto Plus Ltd and are protected by copyright, trademark, and other applicable laws. You may not reproduce, distribute, or create derivative works without our express written consent.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Geto Plus shall not be liable for:
- The condition, safety, or legality of any property listed on the platform.
- The accuracy of listing descriptions or photos provided by hosts.
- The conduct of guests, hosts, or any third parties.
- Any direct, indirect, incidental, punitive, or consequential damages arising from use of the Service.
- Loss of data, revenue, or business opportunities.
- Service interruptions, technical errors, or security breaches beyond our reasonable control.
Our total cumulative liability to you shall not exceed the total fees paid by you to Geto Plus in the 12 months preceding the claim.
12. Dispute Resolution
12.1 Between Users
In the event of a dispute between a guest and a host, both parties should first attempt to resolve it directly. If resolution cannot be reached, either party may contact our Resolution Centre at support@geto.plus. Geto Plus will review the case and make a final determination, which both parties agree to accept.
12.2 With Geto Plus
Any dispute between you and Geto Plus shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in Dodoma, Tanzania, administered under the Tanzanian Arbitration Act.
13. Termination
Geto Plus may suspend or terminate your account at any time, with or without notice, if you violate these Terms, engage in fraudulent activity, or pose a risk to other users or the platform. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination shall do so.
You may close your account at any time through the app settings or by contacting support@geto.plus. Pending bookings must be fulfilled or cancelled before account closure.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the United Republic of Tanzania. Any legal proceedings arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Tanzania, unless otherwise agreed in writing.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by email or in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
